Seventh Circuit Grants Temporary Injunction on ACA’s Contraception Mandate

The Seventh Circuit granted a temporary injunction against enforcement of the Affordable Care Act’s contraception mandate as applied to an Illinois company seeking the injunction.

We conclude that the Kortes have established both a reasonable likelihood of success on the merits and irreparable harm, and that the balance of harms tips in their favor. RFRA prohibits the federal government from imposing a “substantial[] burden [on] a person’s exercise of religion even if the burden results from a rule of general applicability” unless the government demonstrates that the burden “(1) is in furtherance of a compelling governmental interest; and (2) is the least restrictive means of furthering that compelling governmental interest.
